Introduction
Effective Date: 14/08/2025
These Terms and Conditions govern the relationship between James Tugwell (referred to as “the Trainer”) and clients (“Athletes”) participating in coaching services. By engaging with the Trainer, you agree to the following terms:
1. Services Provided
The Trainer offers the following services:
- TPI & other screening (incl. mobility and power)
- 1:1 coaching (in-person and online)
- Group coaching (in-person and online)
- Hybrid packages combining in-person and online training
- Training programs developed via consultation calls
- General training programs
There are no geographic restrictions for online coaching. Athletes are generally expected to provide their own equipment for all services (unless agreed with the Trainer).
2. Payment Policies
- In-person and online sessions (including screens): payment is due per session or as a block of sessions. Block bookings must be paid in full before the first session (unless otherwise agreed with the Trainer).
- Online coaching: monthly payments are due at the start of each calendar month.
- Packages (currently Base and Plus): payment is due 50% at the time of the screen, with the remaining 50% being due immediately prior to the provision of the program.
- Training programs: payment is due prior to the provision of the program.
- Accepted payment methods: Bank Transfer, Direct Debit and PayPal.
- Late or missed payments may result in cancellation of the sessions, online coaching or non-provision of the training programs.
3. Cancellation Policies
- In-person and online sessions (including screens): Athletes must cancel over 24 hours in advance. Late cancellations are non-refundable. If the Trainer cancels, the Trainer will provide as much notice as possible and reschedule at no extra cost to the Athlete.
- Online coaching: A two-week notice period is required to cancel or modify coaching arrangements.
4. Athlete Responsibilities
Athletes engaging with the Trainer agree to:
- Complete a PARQ+ form and sign a waiver (Informed Consent) acknowledging the risks of physical training.
- Self-declare their physical fitness (including consulting with doctors or other healthcare professionals as required) and review health status before completing training sessions.
- Avoid unsafe or inappropriate sessions and consult the Trainer if in doubt.
- Follow all instructions from the Trainer unless the environment is unsafe or a factor has changed before or during the session without the Trainer’s knowledge. Athletes should consider the appropriateness of any instruction under the circumstances.
- Arrive promptly to allow adequate time for instruction.
- Maintain their equipment in good working condition.
- Demonstrate respect for the Trainer, other participants, and facility rules.
- Promptly inform the Trainer of health changes, scheduling conflicts, or training challenges.
- Dress appropriately for training environments and consider external factors like weather or safety.
- Athletes agree to ensure adequate space, flooring, lighting, and safe surroundings before starting online sessions.
- Athletes must ensure their device, internet connection, and audio/visual setup are sufficient for session participation.
- Consider obtaining personal accident insurance.
5. Liability
- Athletes understand that participation in training, whether in-person or online, involves physical exertion and potential risks.
- Athletes accept full responsibility for their participation and waive any claims against the Trainer for injuries, illnesses, or damages sustained during sessions or as a result of following a program.
- Athletes following a training program undertake sessions at their own risk.
- Whilst the Trainer believes that for most people, following the programs and methods will lead to desired results, all exercise programs depend on the individual. Results will be affected by the effort and commitment of the individual, however in some circumstances even where an individual follows our program, they may not achieve the desired results. The Trainer therefore provides no warranties of any kind, expressed or implied, as to the effectiveness of any techniques or programs that the Trainer delivers.
- The Trainer shall have no liability to you for any breach of these terms caused by any event or circumstance beyond his reasonable control.
6. Refund Policies
- In-person and virtual sessions (including screens): refunds may be offered if sessions are cancelled by the Trainer and cannot be rescheduled. No refunds will be issued for completed sessions.
- Online Coaching: partial refunds may be issued at the sole discretion of the Trainer if the agreed-upon service is cancelled or modified.
- Refunds will not be granted for subjective dissatisfaction, such as not meeting performance goals.
7. Data Protection
- Please refer to the Privacy Policy for how your data is processed.
- Athletes shall inform the Trainer if they do not consent to marketing communications.
- Athletes may opt out of public use of images captured during sessions by informing the Trainer.
8. Intellectual Property
- Training programs and content provided by the Trainer are proprietary. Athletes may not share, reproduce, or distribute these without permission.
- Marketing materials, including images and testimonials, remain the property of the Trainer unless athletes opt out.
9. Dispute Resolution
- Disputes will be addressed informally between the Trainer and Athletes in the first instance.
- These Terms and Conditions are governed by the laws of England and Wales.
10. Amendments
- The Trainer reserves the right to modify these Terms and Conditions at any time. Changes will be communicated to Athletes in advance and take effect on the specified date.
Conclusion
By participating in services provided by the Trainer, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
